Terms of Use

These Terms of Use apply to richardsmithcoaching.net and its pages (the “Site”), operated by Richard Smith Coaching (“we,” “us”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Age

Anyone may browse the Site’s public content. Our forms, email subscription, self-assessment, coaching application and call booking are intended only for adults 18 and older.

2. Educational purpose

The Site, videos, books, assessments, resources and coaching are for personal development and education. They are not therapy, counseling, or medical, psychological, legal, financial or other professional advice. Richard Smith is not a psychologist or clinician. If you need professional help, contact a qualified professional. In an emergency, call 911 or your local emergency number.

3. No guaranteed results

Results depend on many factors, including your own effort, choices and circumstances. We do not guarantee any particular result. Examples and stories are illustrations, not typical or expected outcomes.

4. Self-assessments

The Ego self-assessment is a self-reflection tool. It is not a psychological test or a diagnosis of any condition.

5. Discovery calls, payments and cancellations

• Coaching discovery calls are free introductory conversations held on Google Meet. No payment is taken.
• Applying for or booking a discovery call does not create a coaching relationship or commit either of us to work together.
• To reschedule or cancel a call, email [email protected].
• Paid coaching packages are not sold on the Site. Any paid coaching will be governed by a separate written agreement.
• Books linked from the Site are sold and processed by Amazon under Amazon’s applicable policies.

6. Communications

If you submit a form or book a call, we may email you about that request, including confirmations and reminders. We send marketing emails only to people who subscribe or otherwise give separate consent, as described in our Privacy Policy.

7. Intellectual property

The Site’s content, including text, graphics, logos, images, videos, assessments and design, belongs to Richard Smith Coaching or its licensors. You may view the Site and share links to it for personal, non-commercial use. You may not copy, republish, sell or create derivative works from it without written permission.

8. Acceptable use

Please do not submit false information, interfere with the Site, attempt unauthorized access or use the Site for any unlawful purpose. Please do not send sensitive information, such as health details, through our forms.

9. Third-party sites and services

The Site links to third parties such as YouTube and Amazon and uses Google Calendar and Google Meet for scheduling. We are not responsible for their content, products or practices.

10. Disclaimer

The Site and its free content are provided “as is” and “as available,” without warranties of any kind, to the extent the law allows.

11. Limitation of liability

To the extent the law allows, Richard Smith Coaching and Richard Smith are not liable for indirect, incidental, special, consequential or punitive damages arising from your use of the Site, its free educational content or a free discovery call. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

12. Governing law and disputes

These Terms are governed by the laws of the State of Arkansas. If you have a concern or dispute, please contact us first at [email protected] so we can try to resolve it informally. If it cannot be resolved that way, it may be brought in a court with proper jurisdiction.

13. Changes

We may update these Terms. The effective date above shows when they last changed.
